CRIMINAL DEFENSE
At Miller Bradley Law, we understand that few legal matters are more personal or emotionally challenging than those involving your children and family. When the Oregon Department of Human Services (DHS) becomes involved in your family's life, the uncertainty and potential consequences can be overwhelming. Our attorneys are dedicated to protecting parental rights, advocating for children, and helping families navigate Oregon's complex juvenile court system.

With extensive experience in juvenile dependency, delinquency, and termination of parental rights proceedings, our attorneys recognize that every family's circumstances are unique. We approach each case with careful preparation, strategic advocacy, and a commitment to protecting the rights and interests of those we represent.
Juvenile Dependency & DHS Involvement

Juvenile dependency proceedings generally arise when DHS believes a child's safety or welfare may be at risk due to allegations of abuse, neglect, inadequate supervision, unsafe living conditions, or other concerns involving a parent or caregiver. In these situations, DHS may file a petition requesting that the juvenile court assume jurisdiction over the child.
A DHS allegation does not automatically mean a parent has neglected or abused their child, nor does the filing of a dependency petition establish that the allegations are true. Parents have important legal rights throughout theseÂ

proceedings, including the opportunity to challenge the allegations and evidence presented against them.At Miller Bradley Law, we recognize that government intervention can have profound consequences for families. Our attorneys carefully examine the circumstances surrounding DHS involvement, review investigative findings, evaluate the evidence, and advocate for parents throughout the legal process.

Not every dependency case requires the same approach. In some situations, DHS's allegations may be inaccurate, exaggerated, or unsupported by sufficient evidence. When appropriate, our attorneys are prepared to challenge the state's claims through contested hearings and advocate against unnecessary court intervention.

In other cases, addressing legitimate safety concerns and working toward reunification may provide the most effective path forward. This may involve participating in court-ordered services, addressing DHS recommendations, and demonstrating that a safe and stable home environment can be maintained. Our attorneys understand the importance of evaluating every available option rather than applying a one-size-fits-all strategy. Whether challenging DHS's attempt to establish jurisdiction or helping parents navigate the requirements of an existing dependency case, our priority is protecting our clients' rights while working toward outcomes that support family stability and the well-being of children.

Protecting Families Throughout the Dependency Process
Juvenile dependency cases can involve multiple hearings, agency assessments, service plans, and ongoing court oversight. Parents may face difficult decisions regarding visitation, temporary placement, reunification requirements, and the future of their parental rights. Our attorneys assist parents in understanding their rights, responding to DHS allegations, preparing for court proceedings, addressing disagreements involving case plans, and advocating for appropriate visitation and reunification opportunities.
Â
We also understand that dependency proceedings can sometimes progress toward more serious legal action, including termination of parental rights. Because these proceedings may permanently affect the legal relationship between a parent and child, experienced legal representation and early intervention can be especially important. At Miller Bradley Law, we believe parents deserve to be heard, allegations deserve careful scrutiny, and decisions affecting families should be based on reliable evidence and applicable law.

Juvenile Delinquency & Protecting a Child's Future
In addition to dependency matters, our attorneys represent juveniles accused of conduct that would constitute a criminal offense if committed by an adult. These cases are generally initiated through petitions filed in juvenile court and may involve allegations ranging from minor offenses to serious criminal conduct.

Although juvenile delinquency proceedings differ from adult criminal prosecutions, the consequences can still be significant. Depending on the circumstances, a juvenile may face court supervision, probation, placement outside the home, or commitment to the Oregon Youth Authority.
In delinquency proceedings, the state must prove the alleged conduct beyond a reasonable doubt before the court may establish jurisdiction based on that conduct.

Our attorneys understand that young people deserve meaningful legal protections and that a single allegation should not define their future. We carefully evaluate the evidence, challenge unsupported allegations, and advocate for outcomes that consider the juvenile's rights, circumstances, and long-term opportunities.
